Terms And Conditions.

1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of the InsureLoc website, forms, document organization services, secure document portal, and related services (collectively, the "Services"). InsureLoc is operated by InsureLoc by Mitigate America ("InsureLoc," "we," "our," or "us"). By using the Services, submitting information, or purchasing a package, you agree to these Terms. If you do not agree, do not use the Services.

2. What InsureLoc Does

InsureLoc is a documentation and records organization service. We help customers collect, organize, label, store, and maintain records such as photos, receipts, invoices, titles, deeds, vehicle information, serial numbers, warranties, appraisals, insurance documents, emergency contacts, and related proof records. Our Services may include intake forms, asset records, proof document uploads, secure folder organization, missing-item checklists, proof file summaries, Emergency Grab File summaries, and annual proof file checkups.

3. What InsureLoc Does Not Do

InsureLoc does not provide legal advice, insurance adjusting, public adjusting, claim advocacy, financial advice, tax advice, estate planning, appraisal services, or professional valuation services. We do not represent you in an insurance claim or legal matter. We do not guarantee that any insurer, government agency, court, lender, business, or other third party will accept your documentation, approve a claim, reimburse a loss, or provide any specific outcome.

4. Customer Responsibilities

You are responsible for the accuracy, completeness, ownership, and legality of the information and documents you submit. You are responsible for keeping your contact information current, reviewing your file, providing updates, confirming who may access your records, and deciding what documents to upload. You should keep original documents where appropriate and should not rely on InsureLoc as your only record location.

5. Information You Should Not Submit

Unless we specifically request it in writing for a clearly stated purpose, do not submit passwords, PINs, full bank account numbers, full credit card numbers, crypto private keys, seed phrases, security question answers, or other unnecessary sensitive access credentials. For financial accounts, you may provide institution names, account types, contact information, document locations, and the last four digits when useful. Insurance policy numbers, vehicle VINs, titles, registrations, and similar proof documents may be submitted when relevant to your file.

6. Account Access and Security

You are responsible for maintaining the confidentiality of any login credentials and for activity under your account or authorized access. You agree to notify us promptly if you believe your account, portal access, or submitted records have been accessed without authorization. Access to customer records is permission-based and may be limited to authorized users and approved trusted contacts.

7. Third-Party Platforms and Services

InsureLoc may use third-party platforms to support website hosting, forms, payments, secure document storage, email, automation, analytics, and customer communications. Your use of those platforms may also be subject to their own terms, privacy policies, and security practices. We are not responsible for outages, errors, changes, or failures caused by third-party providers, but we will use reasonable efforts to select service providers appropriate for the Services.

8. Payments, Renewals, and Access Periods

Package prices, access periods, renewal fees, and included services are shown on the website or invoice at the time of purchase. Unless otherwise stated in writing, customer access is provided for one year from enrollment and may be renewed annually. Renewal may include continued file access and an Annual Proof File Checkup. If you do not renew, access to some Services may end or be limited. Payment terms, refund eligibility, and cancellation rules will be stated at checkout, on the pricing page, or in a written agreement.

9. Annual Proof File Checkup

The Annual Proof File Checkup is intended to help customers review and update their proof file as life changes. Updates may include new purchases, sold items, new vehicles, policy changes, repairs, renovations, warranties, appraisals, emergency contacts, and trusted contacts. The checkup does not guarantee that a file is complete or that all future documentation needs have been met.

10. Customer Content and Permission to Organize Records

You retain ownership of documents, images, and information you submit ("Customer Content"). You give InsureLoc permission to receive, upload, organize, label, store, process, summarize, and share Customer Content as needed to provide the Services, communicate with you, maintain your account, support authorized access, and comply with law. You represent that you have the right to provide the Customer Content and that doing so does not violate another person’s rights or applicable law.

11. Trusted Contacts and Authorized Users

You may request that certain trusted contacts or authorized users receive access to parts of your file. You are responsible for choosing those individuals and for telling us if access should be changed or removed. InsureLoc may rely on your instructions when granting, limiting, or removing access.

12. Acceptable Use

You agree not to misuse the Services, upload unlawful or malicious content, attempt unauthorized access, interfere with the website or portal, submit false information intentionally, infringe the rights of others, or use the Services for fraud or illegal activity. We may suspend or terminate access if we believe the Services are being misused.

13. No Guarantee of Availability or Preservation

We aim to provide reliable access to the Services, but we do not guarantee uninterrupted availability, error-free operation, or permanent preservation of every file. You should maintain backup copies of important records. The Services are intended to help organize and maintain access to records, not to replace all personal, business, legal, insurance, or financial recordkeeping responsibilities.

14. Disclaimers

The Services are provided on an "as available" and "as is" basis to the fullest extent permitted by law. InsureLoc does not make warranties that the Services will meet every need, prevent loss, prevent identity theft, produce a particular claim or legal outcome, or eliminate all documentation problems. Security controls help reduce risk but cannot guarantee absolute security.

15. Limitation of Liability

To the fullest extent permitted by law, InsureLoc and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, lost business, claim denial, reimbursement denial, or third-party decisions. To the fullest extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid to InsureLoc for the applicable Service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless InsureLoc from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of the Services, violation of these Terms, submission of unlawful or inaccurate Customer Content, or violation of another person’s rights.

17. Changes to Services or Terms

We may update the Services or these Terms from time to time. Updated Terms will be posted on the website with a new effective date. Continued use of the Services after changes are posted means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute will be handled in the courts located in Clayton, Georgia, unless applicable law requires otherwise.

20. Refund / Cancellation Policy

Because InsureLoc services involve document review, file setup, records organization, and secure folder preparation, payments are generally non-refundable once work has begun. Customers may request cancellation before file setup or document organization begins. If no work has started, InsureLoc may issue a refund at its discretion, less any payment processing fees.

Annual renewals may be canceled before the renewal date. Once a renewal payment is processed and annual file access or checkup services begin, the renewal fee is generally non-refundable.

InsureLoc does not guarantee insurance claim approval, reimbursement, warranty payment, legal outcome, or recovery funding.
